一、劳动合同期限TermoftheLaborContract本合同期限类型为期限合同Thetypeofthecontractiscontract〔填“有固定或无固定其中一项〕Fulfillterminableordatelesso本合同期限为年Thetermofthecontractisyears自年月日起至年月日止fromto・双方约定的试用期至年月日止,期F艮为3个月Thetwosidesagreedprobationperiodendson3months1duration.表现优异者,甲方可缩短试用期,但不能少于1个月FortheoutstandinglaborertheprobationperiodcanbeshortenedbyPartyAbutnolessthan1month.以完成一定工作为期限Basedonafixedworkingterm:从年月日起到任务完成时止°startingfromuntilthetaskisfinished.
二、工作内容和义务JobContentandResponsibility
1、乙方同意根据甲方工作需要AccordingtoPartyAsdemand在部门,从事〔管理、销售、技术、生产、后勤等〕工作,并遵守岗位工作制度与合理的工作安排〔包括但不限于工作内容、工作地点〕PartyBagreestoengageinmanagement/sales/technology7/manufacture/logisticsetc.workinthedepartmentandabidebytheworksystemandreasonableworkarrangement.Includedbutunlimitedtojobcontentworkingplace.
2、乙方应当按照甲方岗位职责要求,保质保量完成工作任务;AccordingtoPartyAspostresponsibilityrequirementPartyBshouldfinishworldngtaskwithqualityandquantityguaranteed.
3、甲方本着“一专多能、一职多岗〃的用人原则,可以根据经营需要及乙方的工作能力调整乙方的工作职务和岗位,乙方应服从安排Basedontheprincipleof“oneskillwithmultipleabilityonepostwithmultipleworknandaccordingtothebusinessdemandandPartyBscompetencePartyAmayadjustPartyBsdutyandpostwhilePartyBshouldobeytheadjustment.
三、劳动保护和劳动条件LaborProtectionLaborCondition
1、甲方根据国家有关安全生产、劳动保护、职业卫生的规定,为乙方提供必要的工作条件和劳动保护设施,保障乙方的安全与安康;Accordingtotherelatedstipulationofsafetymanufacture/laborprotection/occupationalhealthfromthestatePartyAprovidesnecessaryworkingconditionandlaborprotectionfacilitiesinsuringPartyBssafetyandhealth.
2、甲方根据国家有关规定制定工时制度,乙方确因生产经营需要延时的,甲方应当依法安排乙方补休或支付相应的加班费;假设乙方实行的是级别工资,则在当月的绩效考核中表达;AccordingtotherelevantregulationsofworkinghoursystemifPartyBneedstoextendtheworkinghoursduetotheneedofproductionandoperationpartyAshallarrangepartyBcompensatorytimeofforpayovertimesalaryinaccordancewiththelaw;IfpartyBisimplementedwagelevelsthecompensationshouldbereflectedintheperformanceappraisalforthemonth.
3、甲方根据国家有关规定为孕期、产期、哺乳期的女职工提供劳动保护;PartyAshouldprovideprotectionforwomenworkersinpregnancychildbirthbreastfeedinginaccordancewiththerelevantprovisionsoftheState.
4、甲方负责对乙方进展政治思想、职业道德、业务技术、劳动安全卫生及有关规章制度的告次口、教育矛口培训oPartyAisresponsibletoprovidepoliticalideologyproSessionalethicsbusinesstechnologylaborsafetyandhygieneandrelatedruleseducationandtrainingforPartyB.
四、劳动报酬Laborremuneration根据“按劳分配〃原则,实行同工同酬,乙方的报酬不得低于当地最低工资标准具体薪酬标准、支付方式以及支付时间按公司制定的《薪酬管理制度》执行AccordingtotheprincipleofdistributionandequalpayforequalworkremunerationofPartyBshallnotbelowerthanthelocalminimumwagestandard.Specificcompensationstandardspaymentandtimeissetbythe“thesystemofcompensationmanagementbythecompany
五、社会保险SocialInsurance甲方应按照国家有关社会保险的法律、法规和政策为乙方缴纳基本养老、基本医疗、失业、工伤、生育保险费用;社会保险费个人缴纳局部,甲方从乙方工资中代扣代缴InaccordancewithnationallawsregulationsandpoliciesrelatingtosocialinsurancePartyAshallpaythebasicpensionbasicmedicalunemploymentworkinjuryandmaternityinsurancecostsforthePartyB;socialinsurancepremiumspaidbyindividualspartiswithholdwagesfromPartyB.
六、劳动纪律和规章制度Labordisciplineandregulations1>甲方依法制定的劳动纪律和规章制度)乙方有义务遵守;LabordisciplineandregulationslegallystipulatedbypartyApartyBshallhavethedutytoabidebyit.
2、签订本合同前,甲方已对乙方进展了劳动纪律、操作规程、管理制度等相应的培训;BeforesigningthiscontractPartyAhastoprovidepartyBthelabordisciplineoperatingproceduresmanagementsystemandthecorrespondingtraining
3、乙方应当遵守甲方的工作操作规程)服从工作安排;PartyBshallabidebytheworkingproceduresobeytheworkarrangementofpartyA.
4、乙方违反劳动纪律或规章制度,甲方有权按本单位的规章制度,给予纪律处分,直至解除本合同IfPartyBviolateslabordisciplineorregulationsPartyAisentitledbytherulesoftheunittogivePartyAdisciplinaryactionuptoterminatethiscontract.
七、劳动合同的变更Thechangeoflaborcontract订立本合同所依据的客观情况发生重大变化,致使本合同无法继续履行的,经双方协商同意,予以变更劳动合同相关内容Iftheobjectivesituationthiscontractbasedonchangessignificantlytoresultthecontractunabletoperformbymutualconsentrelatedcontentinlaborcontractsshallbechanged.
八、劳动合同的解除Theremoveoflaborcontract[一]双方协商一^致,劳动合同可以解除Thetwopartymayterminatethelaborcontractwithmutualagreement.〔二〕乙方有以下情形之一的)甲方可以即行解除劳动合同OfanyofthefollowingcircumstancespartyAmayimmediatelyterminatethelaborcontract.
1、在试用期内被证明不符合录用条件的;Beenprovennottomeettheconditionsofemploymentduringthetrialperiod.
2、采取欺诈手段订立本合同的;Adoptedfraudulentmeanstoenterintothiscontract.
3、严重违反劳动纪律或规章制度给甲方造成重大损害的;SeriouslyviolatedlabordisciplineorregulationstocausesignificantharmtothePartyA.
4、严重失职、营私舞弊,或泄露甲方商业秘密)给甲方利益造成重大损失的;GrossnegligencemalpracticeordisclosureoftradesecretsPartyAtocauseheavylossestotheinterestsofthePartyA.
5、乙方同时与其他用人单位建设劳动关系,对完成本单位的工作任务造成严重影响,或者经用人单位提出)才巨不改正的;PartyAbuiltlaborrelationshipswithotherunittocauseaseriousimpactonthecompletionofthetasksoftheunitorrefusedtocorrecttherulesmadebytheemployer
6、被依法追究刑事责任的Beinvestigatedforcriminalresponsibilityaccordingtolaw〔三〕有以下情形之一的,甲方可以提前30日以书面形式通知乙方解除劳动合同OfthefollowingcircumstancesPartyAcangivenoticetoinformPartyBtoterminatethelaborcontractaheadof30days.J
1、乙方不能胜任工作,经培训或调整工作岗位仍不能胜任工作的;PartyBisnotcompetentforworkaftertrainingoradjustmentofjobs.
2、乙方患病或者非因工负伤,医疗期满后,不能从事原工作,也不能从事甲方另行安排工作的;PartyBwasillorinjuredduetonon-workrelationaftercompletionofmedicalPartAisnotcompetentforhisoriginalworkoralternativearrangedjobs.
3、劳动合同订立时所依据的客观情况发生重大变化,致使劳动合同无法履行,双方协商不能就变更劳动合同达成协议的Iftheobjectivesituationthiscontractbasedonchangessignificantlytoresultthecontractunabletoperformmutualconsentcannotbereachedinchangeofthislaborcontracts.〔四〕有以下情形之一的,甲方可以提前30日通知工会,经工会同意后,与乙方解除劳动合同OfthefollowingcircumstancesPartyAcangivenoticeaheadof30daystoinformtheLaborUnionafteragreementPartyAmayterminatethelaborcontract.
1、甲方依照企业破产法规定进展重整的;PartyArestructuredpursuanttotheEnterpriseBankruptcyLaw
2、甲方生产经营发生严重困难的;ProductionandbusinessoperationofPartyAmetseriousdifficulties.
3、甲方转产、重大技术革新或者经营方式调整,经变更劳动合同后,仍需裁减人员的;productiontechnologicalinnovationorbusinessmethodofPartyAadjustedafterthechangeoflaborcontractsstillneededtoreducestaff.
4、其他因劳动合同订立时依据的客观经济情况发生重大变化,致使劳动合同无法履行的Ifotherobjectivesituationthiscontractbasedonchangessignificantlytoresultthecontractunabletoperform.〔五〕乙方有以下情形之一^勺)甲方不得解除劳动合同OfanyofthefollowingcircumstancespartyAcannotterminatethelaborcontract.
1、在本单位患职业病或者因工负伤并被确认丧失或者局部丧失劳动能力的;Injuredduetooccupationaldiseaseorwork-relatedreasonsandwasconfirmedashavinglostorpartiallylosttheabilitytowork.
2、患病或者非因工负伤,在规定的医疗期内的;Illnessornon-workrelatedinjurywithintheprescribedperiodofmedicaltreatment.
3、女职工在孕期、产期、哺乳期的;womenworkersinpregnancychildbirthbreastfeeding.
4、在本单位连续工作满十五年,且距法定退休年龄缺乏五年的;Workedcontinuouslyfor15yearsandlessthanfiveyearsawayfromhislegalretirementageInthisunit.
5、法律、行政法规规定的其他情形Othercircumstancesstipulatedbylawsandadministrativeregulations.〔六〕乙方解除劳动合同,应当提前三十日〔试用期内提前三日〕以书面形式通知甲方,甲方在乙方完成业务以及清理完债权债务的情况下,可以解除劳动合同OfthefollowingcircumstancesPartyBshallgivenoticetoinformPartyAtoterminatethelaborcontractaheadof30daysaftercleaningupthecreditsanddebts.〔七〕有以下情形之一的,乙方可以通知甲方解除劳动合同OfthefollowingcircumstancesPartyBmaygivenoticetoinformPartyAtoterminatethelaborcontract.
1、在试用期内的;Duringthetrialperiod.
2、甲方以暴力、威胁或者非法限制人身自由的手段强迫劳动的;PartyAforcedPartyAtolaborbyviolencethreatorillegalrestrictionofpersonalfreedom.
3、甲方未按劳动合同约定提供劳动保护和劳动条件的;PartyAfailedtoprovidethelaborprotectionandlaborconditions.
4、甲方未按照劳动合同的约定支付工资报酬的;PartyAfailedtopaywagesinaccordancewiththelaborcontract.
5、法律、行政法规规定劳动者可以解除劳动合同的其他情形Othercircumstancesstipulatedbylawsadministrativeregulationsbywhichemployeemayterminatethelaborcontract.
九、劳动合同的终止Terminationoflaborcontracts〔一〕有以下情形之一的,劳动合同即行终止0fanyofthefollowingcircumstancesthelaborcontractmaybeimmediatelyterminate
1、劳动合同期满的;Thelaborcontractexpired.
2、劳动者开场依法享受养老保险待遇的;Workersbegantoenjoyendowmentinsurancetreatmentlawfully.
3、劳动者死亡)或者被人民法院宣告死亡或者宣告失踪的;Laborerdiedorwasdeclareddeadormissingbythepeoplescourt.
4、甲方被依法宣告破产的;PartyAwasdeclaredbankruptbythepeoplescourt
5、甲方被撤消营业执照、责令关闭、撤销或者提前解散的;BusinesslicenseofPartyBwasrevokedorderedtoclosecancellationorearlydissolutionof.
6、法律、行政法规规定的其他情形Othercircumstancesstipulatedbylawsadministrativeregulations.〔二〕乙方应在劳动合同期满前30天通知甲方,甲方同意续订,乙方应及时申请办理续订手续;假设甲方不同意续订,到期即办理终止合同手续乙方未办理终止合同手续而离职的,甲方保存追究其法律责任的权利PartyBshallgivenoticetoinformPartyAtorenewthelaborcontractaheadof30days.IfPartyAdisagreedtonewaleasethelaborcontractwouldgoexpire.IfPartyBleftwithouttheterminationproceduresPartyAwouldretainrighttopursueitslegalresponsibility.
十、违反劳动合同的责任Breachofdutyofthelaborcontract〔一赔偿经济损失Compensationforeconomiclosses甲方有以下情形之一,给乙方造成经济损失的,应当承当赔偿责任OfanythefollowingcircumstancespartyAshallbeliableforcompensationoftheeconomiclossesofpartyB.1由于甲方制定的劳动合同条款无效的;SinceLaborPartyestablishedthetermsoftheinvalidcontract;
2、违反劳动合同法规定的条件解除劳动合同的ConditionsinviolationoftheprovisionsoftheLaborContractLawtoterminatethelaborcontract.乙方有以下情形之一,给甲方造成经济损失的,还应当承当赔偿责任OfanythefollowingcircumstancespartyBshallbeliableforcompensationoftheeconomiclossesofpartyA.
1、乙方违反《劳动合同法》规定的条件或者劳动合同的约定解除劳动合同,给甲方造成经济损失的,应当按照损失的程度,承当赔偿责任;PartyBviolatedtheconditionsintheLaborContractLaworterminatedthelaborcontracttocausetheeconomiclossesofpartyAPartyBshallbeliableforcompensationoftheeconomiclossesofpartyA.
2、乙方违反劳动合同约定的保密事项,给甲方造成经济损失的,应当依法承当赔偿责任;ConfidentialmattersPartyviolationsoflaborcontractcausingeconomiclossestothePartyshallbeliableforcompensationaccordingtolaw.
3、乙方在合同期内严重违反甲方的有关规章制度、操作规程给甲方造成损失或致甲方聘用的其他劳动者人身损害的,由乙方根据责任的大小负责赔偿InthecontractperiodifPartyBcausedseriousviolationsofrelevantrulesandregulationsofthePartyproceduresorcausedlossesorcausespersonalinjuryofotherworkersemployedbythePartyA.PartyBshallpaycompensationinaccordancewiththesizeoftheresponsibility.〔二〕违约金Penalty
1、甲方为乙方提供专项技能培训,乙方违反培训协议,须向甲方支付违约金;PartyAshallprovidespecialskillstrainingforPartyB.IfPartyBviolatedtrainingprotocolPartyBshallpayliquidateddamagestoPartyA.
2、甲方对乙方实施了竞业限制,乙方违反竞业限制条款,须向甲方支付违约金PartyAimplementedthenon-competitionforthePartyB.IfitisviolatedPartyBshallpayliquidateddamages
十一、双方约定条款AgreedTermsbytwoParties[一]甲方采取了保密措施保护的商业秘密,乙方负有保密义务;PartyAhastakenmeasurestoprotecttheconfidentialityoftradesecretsPartyBhastheconfidentialityobligations.〔二〕甲方可以就保密的内容、范围和地点,双方的权利义务,保密期限,违约责任以及竞业限制条款等与乙方签订协议;PartyAcansignwithPartyonconfidentialityincontentscopeandlocationoftherightsandobligationsofbothpartiestheconfidentialityperiodandbreachofcontractandnon-competeclause.〔三〕假设乙方在甲方是从事过管理、经营、技术工作的,在离开甲方两年以内,不得在本行业内其它企业工作,不得泄露甲方的生产、经营秘密;IfPartyBisengagedinthemanagementoperationtechnicalwork.AfterleavingthepartyinlessthantwoyearsPartyBcannotworkinothercompaniesinthisindustryandshallnotdivulgeproductionbusinesssecretsofPartyA.〔四〕劳动合同依法解除或终止时,乙方应当归还甲方的保密资料WhenthelaborcontractwascancelledorterminatedPartyBshallreturnconfidentialinformation
十二、劳动争议处理Labordisputesettlement本合同发生劳动争议,甲乙双方应本着平等友好原则协商解决,假设协商不成,乙方可以向甲方所在地劳动争议仲裁委员会申请仲裁ForthecontractlabordisputebothpartiesshouldhasaequalityamicablesettlementnegotiationifthenegotiationfailsPartyBcanseatlabordisputearbitrationcommitteeforarbitrationofPartyA.J
十三、附则Bylaws〔一〕本合同未尽事宜可按国家和甲方有关规定执行,没有规定的由甲乙双方协商解决;ThiscontractmaybeoutstandingissuesrelevantprovisionsoftheStateandPartydoesnotrequireconsultationbybothparties〔二〕乙方已确认熟悉甲方的劳动纪律、操作规程、管理制度,按甲方的保密规定保守甲方秘密,相关纪律、操作规程、管理制度作为本合同附件,由甲方保存;PartyBhasconfirmedlabordisciplineproceduresmanagementsystemsaccordingtotheconfidentialityprovisionsoftheconservativePartyA.SecretsrelateddisciplineproceduresmanagementsystemsasanannextothecontractshallbesavedbyParty〔三〕劳动合同一式二份,双方各执一份,经双方签字或盖章之日起生效;Laborcontractshallbeinduplicateeachpartyholdsoneafterthedateofentryitisintoforceofthetwosidesifsignedorstamped.〔四〕劳动合同涂改或未经合法授权代签无效Laborcontractsisinvalidifisalteredorwithoutlawfulauthoritytosign.甲方〔盖章〕乙方〔签字〕PartyAStampPartyBSign法定代表人〔委托代理人〕LegalRepresentativeEntrustedagent签订日期:年月日DateofSigningDayMonthYear。
