①负责施工区域的临时设施、水电管线的铺设、管理、使用和维修工作；Be responsiblefor theworks oflaying,management,use andmaintenance ofthe temporaryfacilities,water andelectricity pipelinein theconstruction area.

②组织施工管理人员和材料、施工机械进场；Organize constructionmanagement staff and constructionmaterials,construction machineryenterthe Site.

③负责在装修期间保持公共地方清洁及每天负责将装物料弃置于由管理处指定的垃圾收集处Be responsiblefor keepingpublic placesclean duringconstruction andpacking constructionmaterialand leavingin thegarbage collectionplace designatedby managementoffice eachday.第三条工程期限Article3Period ofConstruction.根据工期和使用需要，商定工程总施工期为天日历天，自年月日开工至年月日完工1According to the periodof constructionand theuse need,the totalconstruction periodagreedshall bedays Calendardays,start fromthe dateof andcomplete on the dateof.如遇下列情况，经甲方现场代表签证后，工期相应顺延

①按施工准备规定，甲方未协助乙方办理临时水电及垂直运输，影响进场施工；According to the requirementsof constructionpreparation,Party Afail totassist Party B toapplyfor temporarywater andelectricity andvertical transportationand havean impactonParty Bconstruction;

②因甲方提出增减项目而造成重大设计变更，因而影响进度；The materialmodification orchange of design due to theparty As requirement ofaddition ordeletionof projecthave theeffect ofhindrance onthe progressof works.

③未按合同规定拨付预付款、工程款而影响施工；Party Afail topay theadvance paymentand constructioncost to party Band impacttheconstruction progress;

④人力不可抗拒的因素而延误工期The delayof scheduleof constructiondue toForce Majeure.第四条工程质量Article4The qualityof project一.本工程质量经双方研究要求达到双方约定之验收标准The qualityofproject should achievethe requirementsof acceptanceagreed by both parties.二.乙方必须严格按照施工图纸、说明文件和国家颁发的建筑工程规范、规程和标准进行施工，并接受甲方的监督Party Bshould carryontheconstruction instrict accordancewith drawing,specification fileandregulations andspecifications authorizedby thecompetent authoritiesand beunder thesupervisionof Party A.三.乙方在施工过程中必须遵守下列规定Party Bshould,during theconstruction,comply withthe provisions asfollows:由乙方提供给甲方的所有材料必须经甲方同意方可使用，未按要求购买严禁使用；

1.All materialsprovided byParty Bshould besubject tothe approvalof Party A priorto use,Andnone ofthe samebeing boughtwithout conformitywith Party A requirementscan beused.隐蔽工程必须经甲乙双方检查，方可进行下一道工序；

2.The concealedworks should be checkedby bothparties beforethe nextprogress;工程竣工后，乙方按规定对工程实行保修，保修时间自通过竣工验收之日算起，保修期一年

3.Party Bshall takethe liabilityof maintenancefollowing thecomplete of works.The periodofmaintenance shall be oneyear fromthe dayof acceptance of complete.第五条工程价款的支付与结算合同总价Article5Payment and settlement ofthe contract price%,即元x50The totalcontract pricex50%,which isYuan.中期款The paymentof medium-term工程进度过半三日内Within3three daysafter theprogress morethan half.合同总价x%,即元40The totalcontract pricex40%,which isYuan.尾款Final Payment竣工验收结算后七日内Within7seven daysafter the completion acceptanceandsettlement.合同总价即元x10%,The totalcontract pricex10%,which isYuan.第六条施工与设计变更Articles TheModification ofConstruction andDesign一.乙方交付的设计图纸、说明和有关技术资料，作为施工的有效依据，开工前由甲方组织签字认同，作为施工的补充依据，甲、乙双方均不得擅自修改Design drawing,illustration andrelevant technicaldata consignedby partyB arethe basisforconstruction and shall beconfirmed byparty A5s signature,which isdeemed asthesupplementary basisandshallbe modifiedby anyparty withoutauthorization.二.施工中如发现因甲方要求而发生的设计错误或严重不合理的地方，乙方应及时以书面形式通知甲方，由甲方及时会同乙方等有关单位研究确定修改意见或变更设计文件，乙方按修改或变更的设计文件进行施工若发生增加费用包括返工损失、停工、窝工、人员和机构设备调迁、材料构配件积压的实际损失由甲方负责，并调整合同造价If andwhen anyerror ormaterial unreasonableproblem of design duetopartyAsrequirement,Party Bshall notifyParty Apromptly inwriting anddecide theamendment ormodification ofthedesign documentationby theconsultation andnegotiation betweenparties andunitsconcerned.Party Bshall carryout constructionaccording tothe designdocuments modifiedorchanged.If projectcost increaseincluding the actual loss of reworkloss,stoppage orslowdown,personnel andmachine equipmentrelocated,material structures,fixtures backlog,shallberesponsibility byParty A,and beadjusted thecontractpricetogether withParty B.三.乙方在保证工程质量和不降低设计标准的前提下，提出修改设计、修改工艺的合理化建议，经甲方、设计单位或有关技术部门同意后采取实施Any reasonablesuggestion onthe modificationsofdesignand craftproposed byParty B,subject tothe qualityand withoutreducing standardsofdesign,could becarried outupon theapprovalof PartyA,design unitor concernedtechnical department.四.甲方如需设计变更，必须作出正式修改通知书和修改图纸，乙方才予实施重大修改和增加造价时，必须另行协商，乙方才予实施PartyAshould,if anynecessary designchange,make theformal amendmentand modifydrawingsfor Party Bs implementation..Material changesand costincreased mustbenegotiated bybothpartiesbefore PartyB implementthe same.第七条工程验收Article7Acceptance ofproject一.工程施工中地下工程、结构工程必须具有隐蔽验收签证、试水、抗渗等验收合格记录甲方须及时办理验收签订手续The undergroundengineering,structural engineeringin theconstruction ofprojectshouldbechecked andwith issueof certificateand therecord ofacceptanceofwater test,anti-permeability andso on.PartyAshould dealwith theacceptance signedformalities timely.二.工程竣工验收后，甲方才可使用PartyAcan usethe projectafter completionacceptance在规定的保修期内，凡因施工造成的质量缺陷应由乙方无偿保修其保修条件、范围和期限按城乡建设环境保护部城建字第号通知印发的《建筑工程保修办法试行》执行8479In theprovision warrantyperiod,any constructionquality defects,PartyBshould makemaintenancefree ofthe qualitydefect dueto construction,the scopeand durationcarry outaccording totheissuance ofCheng JianNo.79notification”Construction engineeringguaranteemeasures Trialby Urbanand RuralConstruction andEnvironmental ProtectionDepartment

84.第八条违约责任乙方的责任:Article8Liability forbreach ofcontract Responsibilityof PartyB:一.工程质量不符合合同规定的，负责无偿修理和返工Take chargeof gratisrepair and rework ifproject qualitydoesnt meetcontacts stipulation二.工程不能按合同规定的工期交付使用的，按合同中关于建设工期提交或拖后的奖罚规定偿付逾期罚款If failto delivertheconstructionaccordingtothecontracton time,The overduefines accordingtopunishment oraward oftheprovisionconcerning thedelivery ordelay.甲方的责任The responsibilityof PartyA:一.未能按照合同的规定履行自己应负的责任，除竣工日期得以顺延外，还应赔偿乙方由此造成的实际损失Failed tofulfill theirresponsibilities inaccordancewiththe provisionsofthecontract,in additiontothecompletiondate tobe postponedshouldbecompensation fortheactual lossofPartyB.二.工程中途停建、缓建或由于设计变更以及设计错误造成的返工，应采取措施弥补或减少损失同时，赔偿乙方由此造成的停工、窝工、返工、倒运、人员和机械设备调迁、材料和构件积压的实际损失The ongoingproject isstopped,postponed orduetodesign changesandreworkcaused bydesignerrors,should takemeasures toremedy orreduce losses.At thesame time,compensate PartyB theactuallossofworkstoppage,slowdown,re-dispatch rework,reshipment,staffandmechanical equipmentrelocating,the backlogof materialsandcomponents.第九条纠纷解决办法Article9Dispute settlement任何一方违反合同规定，双方协商不成，均可向北京仲裁委员会申请仲裁Either partycould,if anypartys breachand failto negotiation,submit theapplication ofarbitrationtotheBeijing ArbitrationCommittee第十条附则Article10Supplementary一.本合同一式贰份，甲乙双方各执正本一份This contractis executein twocounterparts,each partyholds asingle original.二.本合同自双方代表签字，加盖双方公章或合同专用章即生效工程竣工验收符合要求,待保修期满后合同终止The contractbecomes effectiveafter signingand sealingbybothparties onthis foregoingdate.The projectfinal acceptancemeet therequirements,after theexpiry ofwarranty,ends thecontract.乙方（盖章）（）甲方（盖章）（）委托代PartyBseal:PartyAseal:委托代理人（签章）理人（签章）电话:AgentAgent Tel:日期Date:电话:Tel:日期Date:。
