1.In orderto strengthenthe administrationof theInternational EducationCollegehereafter referred asthe College,maintain normalacademic orderand livingenvironment,build acivilized campus andeducate theforeign studentsto observethe regulationsand abideby thelaw,XXUniversity ofTCM hereafterreferredasthe Universityhas formulatedthese rules and regulationsin accordance with》^XXUniversity ofTCM Penaltiesfor Violatingthe Rulesand Regulationsand the actualities of theCollege.第一条为加强学院管理，维护正常的教学秩序和良好的学习、生活环境，建设文明校园，教育广大留学生遵纪守法，在《XX理工大学学生违纪处分暂行规定》基础上，结合我院实际情况，制定本条例

2.These disciplinary actions andsanctions shallapply to those who are officiallyregistered degree-seeking,or non-degree foreignstudents andstudents fromHong Kong,Taiwan orMacao whenthey are foundto haveviolated the rules and regulations.第二条本条例适用于XX理工大学具有正式学籍的留学生、港澳台学生及进修生

3.The Collegeshall dealwith those who violatethe rules of the University on the principles:1of equity,fairness andjustice,2of combiningeducation withpunishment,3and ofsafeguarding the students9right of appeal.第三条违纪处分坚持公平、公开、公正原则；坚持教育与处分相结合原则；坚持学生的申诉权保障原则

4.These disciplinaryactions andsanctions shall also applyto thosewho violatethe ruleswhen engaginginclinical practicein hospitalsor othersocial activitiesoff the campus.第四条学生在校外参加临床实习、社会实践等社会活动中有违纪行为，参照本条例给予纪律处分Part IITypes andApplication ofPenalties第二章处分种类和运用with referenceto theseRegulations第二十九条本条没有列举的违纪行为，但确要给予处分的，可参照本条例一至二十八条款中类似情况给予处分

5.Those who arefoundto haveviolated the rulesof the University shall be given the following sanctionsdepending on circumstanceslike the seriousness ofconduct,attitude towardshis or her actandbehavior ofrepentance etc.1Disciplinary warning-A writtenstatement to the studentthat his/her behavioris inviolation of therules.The statementclarifies expectedfuture behavior.Further misconductmay betreated withmoreserious sanctions.A recordof theDisciplinary warningshall bemaintained in the disciplinaryfiles.2Demerit record-It is an indicationthat his/her behavioris inserious violationof the rules andfurtherviolation shallresult inmore severedisciplinaryaction,up toand includingDisciplinary Probationor expulsion from the University.The Demeritshall bepublished onthe campusnotice boardand shall benoted in the studentstranscript.3Disciplinary probation-This sanctionisanofficial warningthat the studenfs conductis inviolationof Universityregulations orgovernment laws.Students placedon disciplinary probation aredeemed“notin goodstanding withthe University.The durationwill bea fullcalendar yearand additionalstipulationsshall beenforced.Additional stipulationsshall be,but arenot limitedto,suspension ofrights andprivileges,suspension ofeligibility toparticipate inscholarship orany otheraward ofexcellence selection,andnotation onthestudenfstranscript.During theperiod,reported violationsof therules willresult inExpulsion.A studentmay petitionto havethe probationlifted and/or thenotation removedfrom thetranscript.This petitionwill notbe acceptableif submittedsooner thanone calendaryear from the datetheprobation began.Disciplinary probationshall notbe applicableto thosewho haveonly oneyear tograduate.4Expulsion-This resultin permanenttermination ofstudent statuswithout possibilityofreadmission.Permanent notationof thisaction shall be recordedonthetranscript and thestudentisbarred fromthe University.There aresupplementary sanctionswhich aredescribed as follows:5Compensation forlosses;6Fine;7Confiscation ofprohibited articles.Supplementary sanctionsmay be imposed independently.第五条学生违反校纪校规，视情节轻重，认错态度，悔改表现等，给予下列之一的处分

一、警告

二、记过

三、留校察看

四、开除学籍除以上纪律处罚外，附加处罚如下第2页共10页

六、罚款

七、没收违禁物品附加处罚也可以独立适用

6.Sanctionsfor acts violatingtherulesshall bemitigated under any of the following circumstances:1when thoseresponsible voluntarilyadmit theirmistakes havebehaviors ofrepentance andcorrect9them in time;2when thoseresponsible werecoerced orinduced byothers and then voluntarilyassist theCollege toinvestigatethe incident;第六条违纪者有3or whenthe circumstancesare obviouslyminor andthe harmdone is not serious.下列情形之一者，应当减轻处分

1、能主动承认错误，如实交待错误事实，检查认识深刻，有悔改表现者；

2、确系他人胁迫或诱骗，并能主动协助学校有关部门弄清事实真相、认错态度较好者；

3、其他根据违纪情节、违纪后果等可从轻处分者

7.Heavier penaltiesshall be given for acts violatingtherulesunderanyof thefollowingcircumstances:1When thoseresponsible refuse to admitmistake andshow abad attitudetowards the management;2When thoseresponsible havebeen repeatedlypunished and refuseto amend.3When thoseresponsible takerevenge onthe informantsor witnesses;4When thoseresponsible committheactagainst disciplineganging togetherwith peopleoutside theUniversity;5When thoseresponsible actas ahead duringthe groupviolation;6when thoseresponsible havealready receiveddisciplinary warning or demeritrecord onceandthen commitan actagainst disciplineagain;Expulsion shall be imposedon thosewho havealreadyreceived demeritrecord twiceduring hisorherstay inthe Universityandthencommit violationagain;7When actshave causedrelatively serious consequences orincurred adverseeffect ontheUniversity;8Anyone who receives disciplinary sanction shall be givensuch additionalpunishments:a Thosewho receiveWarning,Demerit Record or Disciplinary Probation shall be cancelledthequalification forscholarship inthe given academic year.b ThosewhoreceiveDisciplinary Probationmay belifted sanctionafter oneyear if they behavewelland nofurther infractionsof the university rulesand regulationsare committed.If not,they shall beexpelled fromthe university.第七条违纪者有下列情形之一者，应当加重处分

1、违纪后拒不承认错误，态度恶劣者；

2、屡犯不改者；

3、对检举人、证人等有关人员打击报复、威胁恫吓者；

4、伙同校外人员作案者；

5、群体违纪为首者；

6、曾受过一次警告或记过处分者，第二次违纪时从重处分；在本校累计受两次记过以上处分者,第三次违纪时，无论情节轻重，一律给予开除学籍处分；

7、违纪行为造成的后果严重，或给学校造成恶劣影响者；

8、受处分者，附加给予以下处罚

（1）受警告、记过至留校察看处分者，一学年内不得参与评定奖学金；

（2）留校察看以一年为期，受留校察看处分者，在留校察看期内有显著进步表现的，可按期解除留校察看；经教育不改的可开除学籍Part IIIActs Violatingthe Rulesand Sanctions第三章违纪行为和处分

8.Whoever commitsthe actsdisturbing publicand academicorder ordisrupting thestability byorganizingand incitingdisturbance,if seriousconsequence incurred,shall beexpelled fromtheUniversity.第八条组织和煽动闹事，扰乱学校和社会秩序，破坏安定团结，造成严重后果者，给予开除学籍处分

9.Whoever violatesChinese lawsand regulationsand is punished by the Public Security organs or judicialorgansshall alsobe giventhe disciplinarypenalties fromthe Universityas follows:1Expulsion fromtheUniversityshall be given tothosewhoare sentencedto publicsurveillance,criminal detentionor reeducationthrough labor;2Demerit record,disciplinaryprobationorexpulsionfromtheUniversityshall be givento thosewhoare detaineddependingon circumstances;3Serious warningor demeritrecord shall be giventothosewhoarewarned orfined bythe PublicSecurityorgans dependingoncircumstances*第九条违犯国家法律、法令、法规，受到公安、司法部门处罚者

1、被判处管制、拘役、劳动教养或有期徒刑以上处罚者，给予开除学籍处分；

2、被处以治安拘留者，视情节轻重，分别给予记过、留校察看或开除学籍处分；

3、被处以治安警告或治安罚款者，视情节轻重，给予严重警告或记过处分第

410.Whoever stealsor defraudsmoney or property andispunishedbythePublicSecurityorgansor页共10页judicial organsshallalsobe givena disciplinaryaction fromtheuniversityas wellas paying back thestolenmoney andgoods infulL Andfor thosewho committhefollowingacts like:1Stealing anofficial seal,confidential documentsor filesshall be given Disciplinary probation andabove2Standing sentry,providing informationor toolsforatheft,deliberately concealingofatheft,orholding,handling orsharing ofany stolengoods shall be given Demerit recordand above;3Stealing othersID toget moneyorpropertyillegally shall be given Demerit recordand above inaddition topayingbackthe moneyand property;4Stealing others internetaccount and consequently causingloss tothe othershall be givenWarning and abovein addition tocompensation for the loss;5Forging aseal foran illegalactivity shall be given Disciplinaryprobationand above;6Causing seriouseconomic andsocial damageby theiroffence shall be given Expulsion fromtheUniversity第十7Stealing ordefacing librarypublications shall be given penalty accordingtothe loss incurred条对偷窃、诈骗他人财物者，除如数偿还赃款、赃物和按公安机关有关规定进行处罚外，学校视情节轻重分别给予警告、记过、留校察看、开除学籍处分另有下列情况的，视情况给予处分一偷窃公章、保密文件、档案等物品者，视其情节和后果轻重，给予留校察看以上处分；二为盗窃者放哨、提供信息和作案工具，或知情不报，或参与窝赃、销赃、分赃者，给予记过以上处分；三盗用他人证件冒领他人钱物者，除追回冒领的钱物外，视情节轻重及作案金额给予记过以上处分；四盗用他人互联网帐户，给他人造成损失者，除赔偿所造成的损失外，给予警告以上处分；五私刻他人印章，或非法伪造公章作案者，给予留校察看以上处分；六作案行为造成重大经济损失和社会危害者，给予开除学籍处分；七盗窃、损毁公用书刊者，视价值金额进行处理；

11.Anyone whodeliberately damagespublic facilitiesshall be given penaltyranging fromWarning toDisciplinary Probation accordingtheloss incurred.第十一条故意损坏公物，除赔偿损失外，将视损坏公物价值给予警告、记过或留校察看处分

12.For thosewhoareinvolved ina fighting:（）1Anyone whodoesnt engageinafighting though,but servesto fanthe flamesofthe fighting shallbe given Warning（）2Anyone whoinstigates afighting andcauses aconsequence shall be given Demerit Record;Ifserious consequenceincurred,the penalty shall beDisciplinary Probation or Expulsion;（）3For theact offighting:•Anyone whofights,causing noinjury,shall be given Warning;第5页共10页•Anyone whofights,causing aminor injury,shall be given Demerit Record orDisciplinaryProbation;•Anyone whofights,causing asevere or even cripplinginjury,shall be given Expulsion;•Anyone whofights witha weaponshall be given Disciplinary ProbationorExpulsion;（）4Anyone whoprovides weaponforafighting:•Shall be given Demerit RecordorDisciplinary Probationif the case isof nogreat consequence;•Shall be given Expulsionif the case isof greatconsequence.（）5For anyonewho triesto retaliateagainst other people afterthefighting,the penaltyshall beincreasedorevenExpulsion shall beimposed.（）6For anyonewho triesto arrangeotherpeopleto willfullytell anuntruth intheir favorafter thefighting,the penaltyshall be increased.（）7Anyone whofights andcauses aninjury shallpay for the medicaltreatment,nutrition feesandcompensation forall theproperty lossincurred in addition tothe disciplinarypenalty.For thosewho failtopay allthe compensationintime,the penaltyshallbe increased toa greaterlevel.第十二条肇事、策划或参与打架斗殴，为打架斗殴提供凶器者（-）虽未动手，但在打架中起哄者，给予警告处分；

（二）唆使他人打架斗殴，并造成后果者，给予记过处分；后果严重者，给予留校察看或开除学籍处分；

（三）打架斗殴者

1、动手打人未伤他人者，给予警告处分；

2、致他人轻伤者，给予记过或留校察看处分；

3、致他人重伤或致残者，给予开除学籍处分；

4、持械打人者，视后果程度，给予留校察看或开除学籍处分；

（四）、为他人打架斗殴提供凶器者

1、未造成严重后果，给予记过处分或留校察看处分；

2、造成严重后果者，给予开除学籍处分；

（五）打架事件终止后，对他人进行报复者，加重处分直至开除学籍；

（六）在处理打架事件过程中，利用不正当手段组织他人提供伪证者，加重处分；

（七）打人致伤者，除按上述给予纪律处分外，均需赔偿受害者的医药费、营养费及损坏的公私财物等一切必要费用，如不按期交纳赔偿费，给予加重一级处分

13.Anyone whorejects ordo somethingto hinderthe managementto inspectdormitory shallbegivenawarning.Students whoabuse oreven assaultthe management shallbegiven seriouswarningoreven aheavierpenalty.第十三条拒绝、妨碍学校管理人员依照校规校纪执行公务者，视其情节轻重给予警告以上处分寻第6页共10页衅滋事、侮辱、漫骂、威胁,、恐吓或殴打教职员工者，视情节轻重给予留校察看以上处分

14.Such actsas defamingothers,committing perjury,forging ortampering withany documentsshall begivendisciplinary sanction.1Anyone whofabricates arumor againstothers andcauses adverseeffect shallbegiven DemeritRecord2Anyone whocommits perjuryandconsequentlycauses troublefor theinvestigation shallbe givenDemeritRecord3Anyone whoforges ortampers withany importantdocument shallbegivenDisciplinaryProbation orExpulsion4Anyone whohides,discards,damages orillegally opensother peoplesletters orparcels shall begiven DemeritRecord andbears allthe responsibilityincurred aswell.第十四条凡诽谤诬蔑他人，有提供伪证、伪造或涂改证件等行为者，分别给予下列处分-捏造事实、诬蔑他人造成不良后果者，给予记过处分；二提供伪证，给调查造成困难者，给予记过处分；三伪造、涂改证件或重要材料，给予留校察看或开除学籍处分；四隐匿、毁弃或私拆他人邮件包裹者，给予记过以上处分，同时负责由此而引起的一切后果

15.Anyone whois foundwatching,collecting orcirculating unhealthyvideo orreading unhealthyorvulgar booksshallbegiven Warning or DemeritRecord.第十五条观看、收藏、传播不健康或低级庸俗的书刊及音像制品、物品者给予警告或记过处分；

16.Any boywho staysthe wholenight atgirls hostelor viceversa shallbegivenDisciplinaryProbationorExpulsion.And anyboy orgirl whoallows thestay shallbegiventhe samedisciplinarysanction.第十六条在异性宿舍留宿或留宿异性者，给予留校察看或开除学籍处分；

17.Anyone whois founddrug takingshallbegiven Expulsion第十七条有吸毒行为者，一经发现，给予开除学籍处分

18.Anyone whoengages inany illegalorganization oractivity withoutapproval fromthemanagement1Shall begivena Public Reprimandor Warningif thecase is not serious andtheoffender amendstheir errors afteradmonition;2Shall begivenDemeritRecord ifthecaseis seriousandrefuseto amendtheir errors*第十八条未经学校批准，策划或参与非法组织活动者一情节较轻，经教育后改正者，给予通报批评或警告处分；二情节严重，经教育坚持不改者，视情况给予记过以上处分

19.Anyone whodrinks excessivelyand makestrouble shallbegivenDemeritRecordor more seriouspenalty accordingto circumstances.第十九条酒后肇事者，视情节轻重，给予记过以上处分

20.Anyone whorents aflat outsidewithout prior approval andneglect adviceto correctshallbegivenDisciplinary Probation.第二十条擅自在校外租房居住，经劝阻无效者，给予留校察看处分

21.Anyone whoswims inriver,lake orreservoir without priorapproval fromthemanagementshallbegiven DisciplinaryProbation第二十一条擅自到江、河、湖泊、水库游泳者，给予留校察看处分

22.Anyone wholeaves thecity ofXX orthe placewhere heor shedoes theinternship withoutpriorapproval duringtheir stayin China,shallbegivenDemeritRecord ifthecaseisnotseriousandtheviolator showswillingness toamend aswell;or shallbegivenDisciplinaryProbationifthecase isseriousortheviolator refuses toamend.第二十二条在校或实习期间，未经批准，擅自离校或离开实习单位回家，或外出XX实习单位所在市、县者，情节轻微，认错态度好者，给予记过处分；情节严重或认错态度不好者，给予留校察看处分

23.Anyone whostays outofthecampus atnight andfails toreturn tothe dormitorybefore thetime asrequiredshallbegivenDemeritRecord.第二十三条在校学生到校外夜宿不归者，给予记过处分

24.Anyone whosets offfirecrackers orfireworks inthecampuswithoutpriorapprovalfromthemanagement shallbegiven Warning.If anylossincurred,punishment shallbe increasedin additiontomaking compensation.第二十四条未经学校许可，随意在校园内燃放烟花、鞭炮者，给予警告处分造成后果者，除追究其经济责任外，还要视情节加重处分；

25.For thosewho violatetherulesandregulationsfor classroom,dormitory,canteen andlibrary asfollows:1Anyone whoviolates therules forpower useinthedormitory shallbegiven Warning.If anylossincurred,punishment shallbeincreasedinadditionto makingcompensation.2Anyone whomakes sucha racketin publicor holdscelebration tillmidnight asto impairotherpeoples dailylife,work orstudy,and refusesto correcttheirerrorsin spiteof admonitionsshallbegivenWarning.3Anyone whodrops litteror sewageinthecampusandrefusestocorrect despiteadmonitions shallbegivenWarning.And ifseriousconsequenceincurred,penaltyshallbeincreased.4Anyone whocauses equipmentdamages,injuries oreven deathsdue tomishandling orviolation oflabordisciplines shallbegivenpenalty inaccordancewiththeseriousnessofthecases inaddition tocompensationfortheloss.第二十五条对违反教室、宿舍、食堂、图书馆等公共场所纪律者，视情节轻重给予下列处分第8页共10页

（一）违反宿舍安全用电管理规定者，给予警告处分；造成后果者，除追究其经济责任外，还要视情节加重处分；

（二）在公共场所大声喧哗或在宿舍内举办庆祝活动至深夜，干扰或影响他人学习、工作和休息，经批评教育不改者给予警告处分；

（三）乱倒污水、垃圾等杂物，影响校内环境卫生，经教育不改者，给予警告处分；造成严重后果者，加重处分；

（四）在学习、实验中违反操作规程或违反劳动纪律造成人身伤亡、设备损失事故者，视情节轻重，给予警告直至开除学籍处分，并视情节赔偿损失

26.Anyone whofails tocomplete theirtask asrequired forno orproper reasonduring internshipshallbegivenWarningormoreseriouspenalty.第二十六条凡在实习期间，无故或非正当理由，不按实习计划完成任务者，给予警告以上处分

27.Anyone whoseaccumulated absenteeismcomes toasfollows:（）112%ofthetotal classhours shallbegivenaPublicReprimand（）212%-25%shallbegivenWarning（）325%-38%shallbegivenDemeritRecord（）438%-50%shallbegivenDisciplinaryProbation（）550%andaboveshallbegiven Expulsion第二十七条一学期内旷课累积占总学时比率达到下列者（-）12%以下者，给予通报批评；

（二）12%-25%者，给予警告处分；

（三）25%-38%者，给予记过处分；

（四）；38%-50%者，给予留校察看处分

（五）50%以上者，给予开除学籍处分

28.Punishment Measuresfor Violationsof Regulationsin exams:（）1Anyone whoviolates examrulesandregulations shallbegivenDemeritRecord;（）2Anyone whocheats inexams shallbegivenDisciplinaryProbation;（）3Anyone whocheats twiceshallbegivenExpulsion（）4Anyone whosits forexam asa ringeror hiresa ringerto sitan examin his/her nameshallbegivenExpulsion.第二十八条考试违纪、作弊者

（一）违犯考场纪律者，给予记过处分；

（二）考试作弊者，给予留校察看处分；

（三）考试作弊累计两次者，给予开除学籍处分；

（四）替人代考或请人代考者，给予开除学籍处分
