1.Any Certificate or report issued in response to this applicationis issuedstrictly subjectto InterteksGeneral Termsand〃Conditions,a copyof whichis availablefrom ournearest Country Office orat ourwebsite:http:

2.Intertek representsand warrantsthat anyCertificateorreportissued inresponsetothis RFC isissuedingood faithand inthereasonable beliefthat it has authorityto doso from the respectiveauthorities orwithin theprovisions ofrelevant decreesissuedby them.

3.The RFCsets outthe entireagreement andunderstanding betweenthe partiesin relationto itssubject matter.The exporteracknowledgesthat,in submittingthe RFC,ithasnot reliedon anyoral orwritten representation,warranty,or otherassuranceexcept asprovided foror referredto in thisRFCand waivesall rightsand remedieswhich mightotherwise beavailableto itin respectthereof,provided always,that nothinginthisclause limitsor excludesany liabilityfor fraud.

4.Inspection Auditorsfromthe CountryOfficeare tobe allowedaccess to the exportersinspection sitewithout priornotice forthepurpose ofensuring thata recentlyperformed inspectionhas beencorrectly conducted.The Auditoris authorizedby theCountryOffice to amend oroverturn theinspection outcomeif theresult of the auditsupports thisaction.In theircourse ofaction,Inspection Auditorswill nothamper orhinder theexport process.

5.In theevent ofconflict betweenthe exporterand anapproved laboratoryrelating to the testingof theproducts,the disputeshall be resolvedby thetwo parties,without involvementor responsibilityon thepart of theCountryOffice CO,Registration andLicensing CentreRLC,Centres ofTechnical ExpertiseCTE orPCP ProgrammeManagement.PCPProgramme Managementshall beinformed ofsuch disputeto allowa reassessmentof thelaboratorys approvalstatus tobemade ifwarranted.

6.In theevent ofconflict betweenthe exporterand anyofthe COs,RLCs orCTEs relatingto theinspection,evaluation,licensing,registration orcertification ofthe regulatedproducts,the exportershall beentitled to submit acomplaint tothe CO,RLC orCTE.If noagreement canbe reached,the exporteris entitledtosubmitan appealtothePCP ProgrammeManagementwithin twoweeks fromthe dateof submittalofthecomplaint totheCO,RLC orCTE.Documents supportingtheexporters pointof viewshallbeattached tothe appeal.PCP ProgrammeManagement undertakesto investigatethecomplaint inaccordance withInterteks internalcomplaints procedure,and issuea decisionthereon within1month fromthedate ofreceipt.

7.The exporteris responsiblefor informingIntertek inadvance ofany applicableimport/export restrictionsthat mayapply,including instanceswhere products,information ortechnology maybe exportedtoacountry thatis restrictedor bannedfromsuch export.

8.The aboveconditions shallbe governedby Englishlaw andany disputearising outof thisRFC towhich theseconditionsapply shallbe subjecttothejurisdiction ofthe EnglishCourts.This clausesupersedes clauses22and24in lntertek5sgeneral termsand conditionswith respectto jurisdiction.。
