租赁合同中英文对照版出租方甲方Lessor hereinafterreferred toas Party A承租方乙方Lessee hereinafterreferred toas Party B根据国家有关法律、法规和有关规定,甲、乙双方在平等自愿的基础上,经友好协商一致,就甲方将其合法拥有的物业出租给乙方使用,乙方承租使用甲方厂房事宜,订立本合同In accordancewith relevantChinese laws、decrees andpertinentrules andregulations,Party Aand Party B havereachedan agreementthrough friendlyconsultation toconcludethe followingcontract.
一、物业地址Location of the premises甲方将其所有的位于合肥经济技术开发区的厂房及其附属设施在良好状态下出租给乙方使用具体见附件厂房平面图Party A will leaseto Party B the premises and attachedfacilities allowned by Party Aitself,which islocated at____________________________________________________________________________________and ingood conditionparty,the partyin breachshould payadditional pensationto theother party.
2.乙方未按合同约定的用途使用租赁物或擅自转租的,甲方可解除合同,并有权扣除保证金作为乙方违约金If Party B failsto usethe leaseitem for the purposeagreedherein orsublets it without authorization,Party Amayterminate the contract andhas theright todeduct the depositas Party Bs liquidateddamages.
十、争议解决Dispute Resolve若双方在执行本合同或与本合同有关的事情时发生争议,应首先友好协商;协商不成,可向合同履行地人民法院提起诉讼本合同一经双方签字后立即生效;未经双方同意,不得任意终止,如有未尽事宜,甲、乙双方可另行协商Both partieswill solvethe disputesarising frome Xecutionof the contract orin connectionwith the contractthrough friendlyconsultation.In casethe agreementcannotbe reached,any partymay summitthe disputeto thecourt thathas the jurisdictionover thematter.H、免责条件eXception clause
1、因不可抗力原因致使本合同不能继续履行或造成的损失,甲、乙双方互不承担责任In theevent of the reasoncaused byforcemajeuremake thecontractnot performor probuctany loss,Party Aor Party Bwill not bear theobligations eachother.
2、因国家政策需要拆除或改造已租赁的房屋,给甲、乙双方造成损失的,互不承担责任If theloss ofboth partiescausedby removeor recontructivethe premiesdue tonationalpolicies,Party Aor Party B will notbearthe obligationseachother.
3、因上述原因而终止合同的,租金按照实际使用时间计算,不足整月的按实际天数计算In theevent of the reasonmentioned above,Payment ofrentalwill becounted atthe actualmonths oractual daysifit dont reacha fullmonth.
十二、其他others
1.本合同附件是本合同的有效组成部分,与本合同具有同等法律效力Any anneXis theintegral partof this contract.The anneXandthis contractare equallyvalid.
2.本合同壹式贰份,甲、乙双方各执一份There are2originals of this contract.Each partywill hold1originals.
3.本合同中英文内容相同,若有不同之处,以中文为准The Chineselanguage versionand theEnglish languageversionofthisAgreement shallhave equallegal effect.Inthe eventof conflict,the Chineselanguage versionof thisAgreementshall prevail.

二、物业状况出租厂房的登记面积为平方米建筑面积房屋结构为钢结构The registeredsize ofthe leasedpremises issquaremeters Grosssize.Thestructureofpremisesis stealstructure;
三、租赁期限Lease term租赁期限自年—月—日起至年—月—日止,为期—年,甲方应于年—月一日将厂房腾空并交付乙方使用The lease term will be frommonthdayyear tomonthdayyear.Party Awill clearthe premises and provideitto Party B foruse beforemonth dayyear.
四、租金Rental
1.数额双方商定租金为每月人民币元整,乙方以形式支付给甲方Amountthe rental will beper month.Party Bwill paythe rentalto Party Ain theform ofin
2.租金按个月为一个支付周期;第一期租金于年月日以前付清;以后每期租金于每一支付周期日以前缴纳,先付后住若乙方以汇款形式支付租金,则以汇出日为支付日,汇费由汇出方承担甲方收到租金后予书面签收Payment ofrentalwill be oneinstallment everymonths.The firstinstallment will be paidbeforemonthdayyear.Each successiveinstallment will be paideach month.Party Bwill paythe rental before usingthe premises andattached facilitiesIn caseParty Bpays the rental intheform ofremittance,the dateof remittingwillbethe dayofpayment andthe remittancefee willbe borneby theremitter.Party Awill issuea writtenreceipt afterreceivingthe payment
3.如乙方逾期支付租金超过十天,则每天以月租金的
0.5%支付滞纳金;如乙方逾期支付租金超过十五天,则视为乙方自动退租,构成违约,甲方有权收回厂房,并追究乙方违约责任In casethe rentalis morethan tenworking days overdue,Party Bwill pay
0.5percent ofmonthly rentalas overduefineevery day,if therentalbepaid15daysoverdue,PartyB willbe deemed to havewith drawnfrom the premises andbreachthe contract.In thissituation,Party Ahas therightto takeback the premisesandtake actionsagainst party Bs breach.
五、保证金Deposit
1.为确保厂房及其附属设施之安全与完好,及租赁期内相关费用之如期结算,乙方同意于年月日前支付给甲方保证金人民币元整,甲方在收到保证金后予以书面签收Guarantying thesafety andgood conditionsofthe premisesand attached facilities andaccount ofrelevant feesaresettled onschedule duringthe lease term,party Bwill paytoparty Aas adepositbeforemonthdayyear.Party Awill issuea writtenreceiptafter receivingthe deposit.
2.除合同另有约定外,甲方应于租赁关系消除且乙方迁空、点清并付清所有应付费用后的当天将保证金全额无息退还乙方Unless otherwiseprovided forby thiscontract,Party Awillreturn fullamount ofthe depositwithout intereston thedaywhen thiscontract eX piresand partyB clearsthe premisesandhas paidall duerental and other eXpenses.
3.因乙方违反本合同的规定而产生的违约金、损坏赔偿金和其它相关费用,甲方可在保证金中抵扣,不足部分乙方必须在接到甲方付款通知后十日内补足In casepartyBbreaches thiscontract,party Ahas righttodeduct the default fine,pensation fordamage orany othereXpensesfrom the deposit.In casethedepositis notsufficient to coversuch items,Party Bshould paytheinsufficiency withinten daysafter receivingthe writtennoticeof paymentfrom Party A.
六、甲方义务Obligations ofParty A
1.甲方须按时将厂房及附属设施详见附件交付乙方使用Party Awill providethe premisesand attached facilitiessee theappendi Xof furniturelist fordetail onscheduleto Party B forusing.
2.厂房设施如因质量原因、自然损耗或灾害而受到损坏,甲方有修缮并承担相关费用的责任In casethepremiseandattachedfacilities aredamaged byqualityproblems,natural damagesor disasters,Party Awillbe responsible to repairand paythe relevanteXpenses.
3.甲方应确保出租的厂房享有出租的权利,反之如乙方权益因此遭受损害,甲方应负赔偿责任Party Awill guaranteethe leaseright ofthe premises.Otherwise,Party Awillberesponsible topensate Party Bs losses.
七、乙方义务Obligations ofParty B
1.乙方应按合同的规定按时支付租金及保证金Party Bwill paytherental,thedepositandothereXpenseson time.
2.乙方经甲方同意,可在厂房内添置设备租赁期满后,乙方将添置的设备搬走,并保证不影响厂房的完好及正常使用Party Bmay decoratethe premisesand addnew facilitieswithParty As approval.When thiscontract eXpires,PartyB maytake awaythe addedfacilities whichare removablewithout changing thegood conditionsofthepremises fornormaluse.
3.未经甲方同意,乙方不得将承租的厂房转租,并爱护使用该厂房,如因乙方过失或过错致使厂房及设施受损,乙方应承担赔偿责任PartyBwillnottransfer thelease ofthepremiseswithoutParty As approvaland shouldtake goodcare ofthepremises.Otherwise,PartyBwillberesponsibletopensate anydamagesof thepremisesandattachedfacilitiescaused by its faultandnegligence.
4.乙方应按本合同规定合法使用该厂房,不得擅自改变使用性质乙方不得在该厂房内存放危险物品否则,如该厂房及附属设施因此受损,乙方应承担全部责任PartyBwill usethepremiseslawfully accordingto thiscontractwithoutchangingthe natureofthepremises andstoringhazardous materialsin it.Otherwise,PartyBwillbe responsibleforthedamages causedbyit
5.乙方应承担租赁期内的水、电、煤气、电讯等一切因实际使用而产生的费用,并按单如期缴纳PartyBwill bearthe costof utilitiessuch asmunications,water,electricity,gas,management feeetc.on timeduringthe leaseterm.
6.乙方自行委托物业管理公司对承租的物业进行管理并签订《物业管理协议》,物业管理费自行承担PartyBwill signeThe Agreementof premisesManagement withthemanagement panywhich wasemployed byPartyBitself,andbear themanagement itself.
7.乙方若需要对租赁物业进行装饰装修、制作外墙广告等,必须经过甲方的同意Without theapproval ofParty A,PartyBcant decoratethepremises,make advertisementetc.on theoutwall.
八、合同终止及解除的规定Termination anddissolution ofthecontract
1.乙方在租赁期满前如需退租或续租,应提前两个月通知甲方,由双方另行协商退租或续租事宜在同等条件下乙方享有优先续租权Within twomonths beforethecontracteXpires,PartyBwillnotify PartyA ifit intendsto eX tendthe leasehold.Inthis situation,two partieswill discussmatters overtheeXtension.
2.租赁期满后,乙方应在当天将厂房交还甲方;任何滞留物,如未取得甲方谅解,均视为放弃,任凭甲方处置,乙方决无异议When theleasetermeXpires,PartyBwill returnthepremises andattachedfacilitiestoPartyA withindays.Any belongingsleft initwithoutPartyAs previousunderstandingwillbe deemedtobe abandonedbyPartyB.Inthis situation,PartyAhastheright todispose ofit andPartyAwillraise noobjection.
3.本合同一经双方签字后立即生效;未经双方同意,不得任意终止,如有未尽事宜,甲、乙双方可另行协商This contract willbeeffective afterbeing signedby bothparties.Any partyhas noright toterminate thiscontractwithout anotherpartys agreement.Anything notcovered inthiscontractwillbe discussedseparately byboth parties
九、违约及处理Breach ofthecontract
1.甲、乙双方任何一方在未征得对方同意的情况下,不履行本合同规定条款,导致本合同中途中止,则视为该方违约,双方同意违约金为人民币元整,若违约金不足弥补无过错方之损失,则违约方还需就不足部分支付赔偿金During theleaseterm,any partywho failsto fulfillanyarticle ofthiscontractwithout theotherpartys approvalwillbedeemedto breachthecontract.Both partiesagree thatthedefault finewillbeIn casethedefaultfine isnot・sufficienttocover theloss sufferedby thefaultless。
