5.1甲方权利与义务a.甲方应保证对该房产拥有完全的所有权,无任何产权纠纷b.甲方应按时提供办理产权过户所需的所有文件资料c.甲方应协助乙方处理该房产在交付前的相关事宜Rights andObligations ofParty A:a.Party Ashall ensurethat ithas fullownership of theProperty withno propertydisputes.b.Party Ashall timelyprovide allnecessary documentsandmaterials forthe propertyownership transferregistration.c.Party Ashall assistParty Bin handlingmattersrelated tothe Propertybefore delivery.
5.2乙方权利与义务a.乙方应按合同约定支付房价款b.乙方应按时提供办理产权过户所需的所有文件资料c.乙方应遵守该房产所在小区的管理规约Rights andObligations ofParty B:a.Party Bshall paythe purchaseprice inaccordancewith theterms ofthis Contract.第6页共10页b.Party Bshall timelyprovide allnecessary documentsandmaterials forthe propertyownership transferregistration.c.Party Bshall complywiththeregulations oftheresidents covenantinthecommunity wherethe Propertyislocated.第六条违约责任Article6:Liability forBreach ofContract
6.1若甲方未按合同约定履行义务,视为违约违约金为元或房价款的%
6.2若乙方未按合同约定履行义务,视为违约违约金为元或房价款的%
6.3因不可抗力导致合同无法履行的,双方协商解除合同,互不承担违约责任
6.4任何一方违约,守约方有权解除合同并要求违约方赔偿损失If PartyA failsto fulfillits obligationsas agreedinthis Contract,it shall be deemedin breachof contract.Thepenalty shall be RMBor%of thepurchaseprice.If PartyB failsto fulfillits obligationsas agreedinthis Contract,it shall be deemedin breachof contract.Thepenalty shall be RMBor%of thepurchaseprice.第7页共10页If the performanceofthis Contractis preventedby forcemajeure,the Contract may bemutually agreedupon fortermination,and neitherparty shall be liablefor breachofcontract.Any breachof contractby eitherparty shallentitle thenon-breaching partyto terminatethis Contractand demandcompensationfor losses.第七条争议解决Article7:Dispute Resolution
7.1因履行本合同发生的一切争议,双方应友好协商解决
7.2协商不成的,任何一方均可向该房产所在地有管辖权的人民法院提起诉讼All disputesarising from theperformanceof thisContractshallberesolved byfriendly negotiationsbetweenthe parties.If negotiationsfail,any partymay bringa lawsuittothe PeoplesCourt withjurisdiction atthe locationoftheProperty.第八条其他条款Article8:Other Provisions
8.1本合同未尽事宜,双方可另行签订补充协议,补充协议与本合同具有同等法律效力
8.2本合同一式份,甲、乙双方各执一份,其余用于办理相关手续
