2025船员雇佣合同协议书范本模板中英文版雇佣合同协议书本雇佣合同协议书（以下简称“本合同”）由以下双方于年月日在（地点）签订甲方（雇主）名称地址法定代表人联系方式乙方（船员）姓名性别出生日期身份证号/护照号码地址联系方式鉴于甲方作为船东或船员管理公司，需要雇用乙方为船员服务于（船只名称/类型），乙方愿意接受甲方的雇用，担任（职位名称）一职为明确双方的权利和义务，依据相关法律法规，双方达成如下协议第一条合同期限

1.1本合同的期限为年月日至年月日，具体起止日期以甲乙双方签字盖章为准第1页共10页

1.2合同期限届满后，经双方协商一致，可以续签合同若双方未在合同期限届满前天内书面通知对方终止合同，则本合同自动延续至新的合同期限

1.3本合同的终止或解除，应按照本合同的相关条款以及中国的法律法规办理第二条雇佣职位与职责

2.1乙方受雇于甲方，担任（职位名称）一职乙方的具体工作内容和职责详见本合同附件《岗位职责说明书》

2.2乙方应严格遵守甲方的规章制度，包括但不限于《船员手册》、航行规则、港口规定以及其他适用的法律法规

2.3乙方应尽职尽责地完成甲方分配的工作任务，并服从甲方及其船上负责人的合理安排和指挥

2.4乙方在履行职责期间，应确保自身和他人的安全，遵守安全操作规程，防止事故的发生

2.5乙方应当遵守国际海事组织（IMO）的相关规定以及船旗国和港口国的法律要求第三条工资与福利

3.1乙方的月基本工资为人民币（或其他货币）/月，按月支付工资支付方式为（银行转账/现金），付款日期为每月日

3.2除基本工资外，乙方还将享有以下福利加班费按国家和行业的相关规定支付；奖金根据乙方的工作表现和公司的绩效考核结果发放；伙食补贴人民币/月；节日补贴人民币/年；第2页共10页社会保险甲方为乙方缴纳（具体险种）

3.3乙方享有国家法定节假日、年假、病假及其他假期，具体假期天数及待遇按照甲方的《员工手册》执行第四条工作时间与休息

4.1乙方的工作时间为每天小时，每周工作天具体排班安排由甲方根据实际情况确定，并提前通知乙方

4.2乙方享有休息时间，包括但不限于公休日、法定节假日以及工作日的休息时间乙方在休息期间应遵守甲方的相关规定

4.3加班情况如因工作需要，甲方安排乙方在休息时间工作的，应按照国家法律法规支付加班费或安排补休

4.4乙方在船期间的伙食、住宿及其他生活安排，由甲方负责提供或承担费用第五条工作条件与安全

5.1甲方应为乙方提供符合国际和国内相关法律法规的工作条件和劳动保护措施，确保乙方在工作期间的安全与健康

5.2乙方应严格遵守安全操作规程，正确使用劳动保护用品，防止意外事故的发生

5.3乙方在工作中发现任何可能危及自身或他人安全的行为或隐患时，应立即向甲方报告

5.4甲方应定期为乙方安排健康检查，并为乙方提供必要的医疗保障第六条合同的变更与终止

6.1本合同的任何变更，应由双方协商一致，并以书面形式确认后方可生效第3页共10页

6.2在合同期限内，若因不可抗力或双方协商一致，可以提前终止本合同终止合同应提前天以书面形式通知对方

6.3任何一方违反本合同的约定，另一方有权解除合同，并要求赔偿造成的损失

6.4合同终止后，甲方应为乙方办理相关手续，并依法支付未结清的工资、福利及其他费用第七条争议解决

7.1本合同履行过程中如发生争议，双方应通过友好协商解决

7.2协商不成时，任何一方均可向甲方所在地的劳动争议仲裁委员会申请仲裁

7.3对于仲裁裁决不服的，可在接到裁决书之日起日内向甲方所在地人民法院提起诉讼第八条其他条款

8.1本合同未尽事宜，双方可另行协商并签订补充协议，补充协议与本合同具有同等法律效力

8.2本合同的解释和适用，均依照中华人民共和国的法律法规执行

8.3本合同一式两份，甲乙双方各执一份，具有同等法律效力

2.4Party Bshall ensurethe safetyof themselvesandothers during the performance of theirduties,comply withsafetyoperating procedures,and preventaccidents fromoccurring.

2.5Party Bshall complywith relevantprovisions of theInternational MaritimeOrganization IMO,as wellas thelawsand regulationsof theflag stateand portstates.Compensation andBenefits

3.3Party Bis entitledto nationalstatutory holidays,annual leave,sick leave,and otherleaves,with specificleavedays andbenefits inaccordancewithParty AsEmployeeHandbook.Working Hoursand Rest

4.1Party Bsworking hoursare hoursperday,days perweek.Specific schedulingisdetermined byParty Aaccording toactual circumstancesandcommunicated toParty Bin advance.

4.2PartyBis entitledto resttime,including butnotlimited topublic restdays,statutory holidays,and resttimeduring workdays.PartyBshall complywithParty Asrelevant regulationsduring restperiods.

4.3Overtime situation:If PartyA arrangesfor PartyBto workduring resttime due to workrequirements,Party Ashallpay overtimepay orarrange forcompensatory restinaccordance withnational lawsandregulations.

4.4During thetime onboard,PartyAis responsibleforproviding orbearing thecosts ofParty Bsmeals,accommodation,and otherliving arrangements.Termination andAmendment ofContract

6.1Any amendmenttothisContract mustbe agreedupon bybothparties inwriting andconfirmed inwriting tobeeffective.第8页共10页

6.2During thetermof the Contract,if eitherpartywishes toterminate theContract提前in advancedueto不可抗力force majeureor mutualagreement,they mustnotifythe otherparty inwriting daysprior.

6.3Any breachofthisContractbyone partyentitles theotherparty toterminate theContractandseek damagesforlosses incurred.

7.1If anydisputes ariseduringtheperformanceofthisContract,bothpartiesshall attemptto resolvethem throughfriendly协商consultation.

7.2If协商不成unable toreach anagreement,eitherparty mayapply forarbitration tothe labordisputearbitration committeeatPartyAs location.

7.3If dissatisfiedwith thearbitration award,eitherparty maybring alawsuit tothe peoplescourt atParty Aslocationwithin daysof receivingthearbitration award.Miscellaneous Provisions
