6.7保证施工安全，承担因施工原因造成的人员伤亡和财产损失的责任

6.8保护施工现场环境，防止污染和破坏第七条权利与保证

7.1甲方保证其提供的文件和资料真实、准确、完整

7.2乙方保证其具备完成工程的资质和能力

7.3乙方保证其施工不会侵犯他人的合法权益

7.4未经甲方书面同意，乙方不得将合同权利义务转让他人第八条变更与签证

8.1工程变更a.因甲方要求改变工程内容或技术标准的，双方应签订书面变更协议b.因变更导致的费用增加或工期延长，双方应协商确定

8.2签证a.变更发生后，乙方应在日内向甲方提交签证申请b.甲方应在收到签证申请后日内予以确认或提出异议第九条竣工验收与保修

9.1工程竣工后，乙方应向甲方提交竣工报告

9.2甲方应在收到竣工报告后日内组织验收

9.3验收合格后，双方签署《竣工验收报告》

9.4质保期内，乙方应按约定对工程进行维护和修复第十条不可抗力第4页共10页

10.1不可抗力指不能预见、不能避免且不能克服的事件，如自然灾害、战争等

10.2因不可抗力导致的停工，双方协商解决，不承担违约责任

10.3不可抗力持续超过天，双方可协商终止合同第十一条违约责任

11.1甲方违约责任a.未按约定支付款项，每逾期一日，按逾期金额的‰支付违约金

11.2乙方违约责任a.未按工期完成工程，每逾期一日，按合同总价的‰支付违约金b.工程质量未达到约定标准，乙方应返工并承担相关费用第十二条合同的生效与终止

12.1本合同自双方签字盖章之日起生效

12.2本合同在工程竣工验收合格、质保期满且双方结清所有款项后终止第十三条争议解决

13.1因履行本合同发生争议，双方应友好协商解决

13.2协商不成，任何一方可向工程所在地人民法院提起诉讼第十四条其他条款

14.1本合同未尽事宜，双方可签订补充协议，补充协议与本合同具有同等法律效力
