一、租赁范围Lease Scope

二、租赁期限Lease Duration乙方租赁甲方土地的年限为一年一个月不得超过甲方农户的土地承包

1.年限，自年—月—日至一年一月—日“租赁期限—年—月—日租赁起始日Party Awill leasethe Lease Land to Party B for yearsand___________months startingfrom_to thelease durationshould bewithinthe landcontract period of the contract holding farm householdcontractuhereinafter referredto asLease Duration.is theleasing commencementdate.租赁期限期满后如乙方需继续租赁，则须在租赁期限期满前一个月甲方

2.协商在同等条件下，乙方对该租赁土地有优先承租权In caseParty Bwants tocontinue leasingthe landupon the expirationof the Lease Duration,Party B should informParty Afor negotiationmonthsprior to theexpiration of the Lease Duration.Under thesame conditions,Party Bhas the right offirst refusalfor rentingthe Lease Land.

三、租赁费用Lease Price双方一致同意，该租赁土地的第一租约年年租金为每亩人民币—元以

5.约定的租金标准，及时按比例向相关农户进行发放，如果因甲方原因而引发承包农户与乙方之间的矛盾，甲方必须承担全部责任如果因承包农户与乙方之间的矛盾而造成乙方遭受损失的，甲方应赔偿乙方因此而遭受的全部损失如适用After receivingthe paymentofrentfrom Party B,Party A shall promptlypaysuch rent payment tothe contract holding farm households inproportionto the land areaofeachof the contract holding farm households accordingto therent standardagreed above.Should any disputes occurbetween Party B and the contractholding farmhouseholdsdue toParty A s cause,Party Ashall takefull responsibilityforsuch disputes.Should Party B incur any losses caused by disputes betweenParty B and the contractholding farmhouseholds,Party Ashall compensateParty Bforall thelosses sosuffered byParty Bif applicable.

四、其他约定Miscellaneous terms乙方在租赁期限内必须遵守国家的法律法规，保护当地环境，做好环评，

1.并搞好卫生防疫工作因乙方的养鸡污染而造成的直接损失由乙方负责承担Party Bshall complywith all the relatedlaws andregulations of thestate andprotect thelocal environment,fulfill environmentassessment workaswell asperform hygieneand quarantineduties.In caseany directdamagecaused bythe pollutionfrom Party Bsbroiler breedingfarm,Party B shouldbe responsiblefor therelated compensation.乙方租用甲方所辖土地，在签订本土地租赁协议书后，应向甲方一次性

5.系乙方在项目建设和生产过程中因承包户、当地居民包括周边群众等人为因素迫使乙方停工、停产或减产的，甲方必须全力配合乙方，及时协调解决若在天内未能协调解决，由此给乙方造成损失的，甲方必须赔偿乙方的全部损失在问题协调解决并且乙方恢复正常建设工作或正常经营活动前，乙方有权缓付租金并且不承担逾期付款违约责任;如果问题未能在一天之内解决，则乙方有权从任何应付租金中扣除问题未解决期间天数的相应租金金额;如果因甲方未能及时协调解决前述问题，导致本协议无法履行或本协议目的不能实现，乙方有权以书面通知方式解除本协议并且要求甲方赔偿乙方遭受的全部损失，包括本协议无法履行或本协议目的不能实现所遭受的预期利润损失Party Ahas theobligation tocoordinate therelationship betweenPartyB andall contractholdingfarmhouseholds andother localresidents.If,during theconstruction periodor productionperiodofthe Project,PartyB sconstruction andproduction processis suspendedor PartyBs productionis reduceddue toreasons ofthecontractholdingfarmhouseholds orlocalresidents includingsurrounding residents,Party Ashall fullycooperatewith PartyB topromptly solvethe problems.If theproblems arenot solvedwithindayscausing lossestoPartyB,Party Ashall compensatePartyBfor allthelosses sosuffered byPartyB.Before theproblems aresolved andPartyB snormal constructionwork ornormal operationis resumed,PartyBhasthe rightto withholdrentpaymentwithout anyliabilitiesforlatepayment;If theproblems havenot beenresolved withindays,then PartyBshall havethe rightto deductfrom anypayable rentthe amountofthecorrespondingrent forthe daysoftheperiod forwhich theproblems havenot beenresolved;If this Lease Agreement cannot beperformed orthepurpose ofthis LeaseAAgreement cannotbe achieveddue toPartysfailure tocoordinate andsolvethe aforesaidproblems,PartyBshallhavetherightto terminatethis LeaseAgreementby givingParty Aa writtennotice andto requestParty Atocompensate PartyBforall lossessuffered byPartyB,including theexpectedprofits lostduetothe nonperformanceofthisLease Agreementorthefailureof thepurpose ofthisLeaseAgreement.在乙方租赁期内，甲方承诺并负责监督、协调下述事宜在本村区域内

6.距乙方租赁土地的饲养场—公里范围内，甲方不得自建或把所辖土地租赁给他人建办养禽场，以防疫病的相互感染，进而影响乙方的生产，但是截至本协议签订之日已存在的养禽场除外;在租赁期限内，甲方确保，在乙方租赁土地的场周围—公里且属于本村区域的范围内不得再建造影响乙方生产和防疫的其他任何建筑设施如果因甲方违反前述承诺，给乙方造成损失的，甲方必须赔偿乙方的全部损失如果因甲方违反前述承诺导致本协议无法履行或本协议目的不能实现，乙方有权以书面通知方式解除本协议并且要求甲方赔偿乙方遭受的全部损失，包括本协议无法履行或本协议目的不能实现所遭受的预期利润损失During theLease Duration,PartyAcommits andundertakes tosuperviseand coordinatethefollowingmatters:except forthe chickenfarms existingontheexecutiondateofthis Agreement,forthesake ofdisease control toavoid threadsto underminePartyBs production,PartyAshould notbuildor leasethelandunder itscontroltoany thirdparty tobuild farmswithinthe areaofkilometer radiusfrom PartyBs farm ontheLeaseLand within the village;During theLease Duration,PartyAshall ensurethat nostructure orbuildingthat affectsPartyBsproductionand quarantinebe builtwithinthearea,which belongstothevillage ofPartyAand whichis withinkilometer radiusfromPartyBsfarmontheLeaseLand.If PartyA breachesthe aforesaidcommitmentscausing lossestoPartyB,PartyAshall compensatePartyBforall thelosses sosuffered byPartyB.If thisLeaseAgreementcannot beperformedorthepurposeofthisLeaseAgreementcannotbe achieveddue toPartyAsbreach ofthe aforesaidcommitments,PartyBshall。
