31.4SigningInstructions法律依据本合同依据《中华人民共和国劳动合同法》年修订版及相关法律法规制定,

1.合同一式两份,双方各执一份,具有同等法律效力The contractis madein duplicate,with eachparty holdingone copy,and bothcopies havethesame legaleffect.合同涂改处需经双方签字或盖章确认,否则无效涂改Any inthe contractmust beconfirmed bythe signatureor sealofbothparties;otherwise,it shallbe invalid.第二章合同期限与试用期Chapter2Contract Termand Probation Period合同期限

22.3ProbationPeriod期限约定
1.固定期限合同试用期最长不超过个月根据合同期限按比例确定,如年合同试用期6142个月a.Duration:For fixed-term contracts:The probation period shall not exceed6months determinedproportionallyaccording tothe contractterm,e.g.,2months fora1-year contract.无固定期限合同试用期最长不超过个月6For open-ended contracts:The probationperiod shallnot exceed6months.以完成一定任务为期限的合同不得约定试用期For task-based contracts:No probationperiod shallbe agreedupon.工资标准
1.试用期工资不得低于本单位相同岗位最低档工资的且不得低于用人单位所在地最低工80%,资标准a.Salary Standard:The probationperiod salaryshallnotbe lowerthan80%of theminimum salaryfor thesameposition inthe employersunit andshallnotbe lowerthan thelocal minimumwagestandard wherethe employeris located.解除条件
1.试用期内,双方均可依据《劳动合同法》第三十九条、第四十条解除合同,但需书面说明理由a.Termination Conditions:During theprobationperiod,either partymay terminatethecontractinaccordancewithArticles39and40oftheLabor ContractLaw,provided thatwritten reasonsare stated.第三章工作内容与工作地点Chapter3Job Contentand Work Location工作岗位

1.oa.Primary WorkLocation:.异地派遣因工作需要,甲方可安排乙方至具体地点工作,乙方应服从合理调酉己异地

334.3Job Requirements乙方需遵守甲方依法制定的规章制度,按时完成工作任务,保守商业秘密
1.a.Party Bshall complywith therules andregulations lawfullyestablished byParty A,complete worktasks ontime,and keepbusiness secretsconfidential.甲方可根据经营需要调整乙方岗位,但需与乙方协商一致,并签订书面变更协议

2.Party Amayadjust Party Bs jobposition accordingto operationalneeds,provided thatit reachesaconsensus with Party Band concludesa writtenmodification agreement.第四章工作时间与休息休假Chapter4Working Hoursand RestLeaves工时制度
4.1双方约定按以下第种方式执行
4.1Working HourSystem Thepartiesagreetoimplement thefollowingoption:标准工时制每日工作不超过小时,每周不超过小时
1.840a.Standard WorkingHours:No more than8hours ofwork perday andno morethan40hours perweek.综合计算工时制以周/月/季/年为周期,总工时不超过法定标准

2.Comprehensive Calculationof WorkingHours:Calculated ona cycleofweek/month/quarter/year,with thetotal workinghours notexceeding thestatutory standard.不定时工作制适用于高级管理人员、外勤人员等特殊岗位

3.Flextime System:Applicable tospecialpositions suchas seniormanagement personneland fieldstaff.加班管理

24.2Overtime Management甲方安排加班需与工会或乙方协商,一般每日不超过小时,特殊情况不超过小时/月
1.13a.Party Ashall consultwiththelabor unionor Party B whenarranging overtimework,generally notexceeding1hour perday andno morethan3hours permonth underspecialcircumstances.加班费计算标准
2.平日加班工资x150%;休息日加班工资无法补休;x200%法定节假日加班工资x300%a.Overtime paycalculation standards:Weekday overtime:Salary x150%;Rest dayovertime:Salary x200%if nocompensatory leaveis provided;Statutory holidayovertime:Salary x300%.休息休假

34.3Rest andLeaves法定休假乙方享有带薪年假、婚假、产假、丧假等法定假期
1.a.Statutory Leaves:PartyBis entitledto statutoryleaves suchas paidannual leave,marriage leave,maternity leave,and bereavementleave.年休假
2.工作满年不满年天/年;1105满年不满年天/年;102010满年以上天/年2015a.Annual Leave:5days peryear foremployees with1to10years of service;10days peryear foremployees with10to20years ofservice;15days peryear foremployees with20or moreyears ofservice.第五章劳动报酬与社会保险Chapter5Labor Remunerationand Social Insurance工资标准

45.5SocialInsurance缴纳义务甲方依法为乙方缴纳养老、医疗、工伤、失业、生育保险,乙方承担个人缴费
1.部分a.Contribution Obligations:Party Ashall lawfullycontribute topension,medical,work-related injury,unemployment,and maternityinsurance forPartyB,withPartyBbearing theindividual contributionportion.转移衔接合同解除/终止后,甲方应在日内办理社保转移手续

152.TransferProcedures:Upon terminationor expirationofthecontract,PartyAshall completethe socialinsurancetransfer procedureswithin15days.。
